This CRLMC has been filed challenging the order dated 27.12.2021 passed by the learned District and Sessions Judge, Jajpur, in Criminal Appeal No. 15 of 2020 and to direct the accusedappellant to make statutory deposit of 25% of the compensation amount.

The accused has been arrayed as Opposite Party No.2 in the CRLMC. By order dated 20.01.2022, notice had been issued to the opposite parties through registered post and the impugned order dated 27.12.2021 had been directed to be stayed. But, it appears notice sent to the Opposite Party No.2 had returned un-served with an endorsement “not found” and none had appeared on behalf of the Opposite Party. Till date, no counsel has appeared on behalf of Opposite Party No.2.

A report has been received from the learned District and Session Judge, Jajpur that the statutory deposit has not been made by the appellant in the appeal.

Mr. Behera, learned counsel for the Petitioner submits that as the Opposite Party No.2 is likely to avoid receipt of notice, CRLMC may be disposed of, directing for expeditious disposal of the Criminal Appeal.

In view of the nature of order, this court proposes to pass, steps need not be taken for issue of fresh notice to the Opposite Party No.2.

Without going into the merits of the CRLMC, it is disposed of requesting the learned District and Session Judge, Jajpur to dispose of Criminal Appeal No. 15 of 2020 expeditiously, preferably within a period of six months from the date of production of certified copy of this order, if there is no other legal impediment.
