1. The appellants have been convicted for the alleged commission of the offence punishable under Section 324/34 of the IPC and sentenced to undergo R.I. for one year by the learned trial court vide judgment and order dated 24.09.1994 passed by the learned Sessions Judge, Sambalpur in S.T. Case No.31 of 1994. The appeal against the judgment of conviction and order of sentence has been pending since 1994.

2. Pursuant to the orders dated 07.11.2025 and 14.11.2025, the learned State Counsel has placed on record the report dated 10.11.2025 received from the Senior Superintendent, Circle Jail, Sambalpur. As per the said report, the appellant no.2- Arjun Kalo, son of

Satrughan Kalo has expired in the year 2002. Therefore, the present appeal qua the appellant no.2Arjun Kalo stood abated in absence of any application under Section 394 of the Cr. P.C. by the legal heirs or the next friend of the deceased appellant no.2. The said report is taken on record.

The said report further reveals that the appellant no.1 as well as the deceased appellant no.2 have already served out the entire sentence of one year awarded to them by the learned trial Court while convicting them for the offence under Section 324/34 of the IPC.

3. In view of the above, Mr. Janmejaya Katikia, learned Amicus Curiae submits that he does not want to press the present appeal. He further submits that he has personally contacted the appellant no.1Bhima Kalo, who has orally instructed him that he does not want to proceed with this case anymore questioning the conviction so as to come out from the stigma attached to the conviction, as he has already served out the entire sentence period.

4. In view of the aforementioned, the CRA stands disposed of.
