1. The petitioner is aggrieved by the order dated 21.10.2024, whereby the learned trial court directed the petitioner to deposit 20% of the cheque amount under Section 143 (A) of N.I Act.

The petitioner/accused moved an application seeking direction to the complainant for placing on record his accounts statement, which was also turned down by the learned court below, vide order dated 26.09.2024. The petitioner is also aggrieved by the said order.

The present petition has been filed challenging both the orders dated 21.10.2024 and 26.09.2024.

Learned counsel for the petitioner fairly submits that he would comply the order dated 21.10.2024 by depositing Rs.1,00,000/- being 20% of the total cheque amount, as per Section 143(A) of the N.I. Act. So far as the other prayer seeking direction to the complainant to place on record the accounts statement is concerned, he would agitate the said point at the final stage of the case.

In view of the submission made by the petitioner, which has not been seriously opposed by the counsel for the opposite party-complainant, I partially allowed the petition directing the petitioner to deposit 20% of the total cheque amount within a period of one week from today, as per the provisions under Section143(A) of the N.I. Act. In so far as the other prayer is concerned, liberty is granted to the petitioner to urge all these points at the final stage of hearing of the case. On deposit of 20% of the total cheque amount by the petitioner, the same shall be disbursed to the complainant with any condition if the court below deems it essential.
