This is a bail application U/S.483 of BNSS by the petitioners for grant of bail in connection with Karlapat PS Case No.30 of 2024 corresponding to CT Case No.96 of 2024 pending in the file of learned Addl. Sessions Judge-cum-Special Court under POCSO Act, Bhawanipatna for commission of offences punishable U/Ss.70(2)/109(1) of BNS r/w Sec.6 of POCSO Act, on the main allegation of committing Gang Rape and aggravated penetrative sexual assault upon the victim. 3. Heard, Mr. Satya Narayan Mishra-4, learned counsel for the petitioners and Mr. M.R. Patra, learned Additional Public Prosecutor in the matter and perused the record together with the evidence of the victim as supplied. None appears for the victim despite having entered appearance through a counsel.

After having considered the rival submissions and taking into consideration the nature and gravity of the offences as alleged against the petitioners vis-a-vis

the accusation sought to be brought against them and regard being had to the materials placed on record together with the evidence of the victim and keeping in view the trial being at its fag end with examination of 14 out of 16 witnesses in the meantime and taking into account the other circumstances on record in entirety, this Court is not inclined to grant bail to the petitioners at this stage.

Hence, the bail application of the petitioners stand rejected. Accordingly, the BLAPL stands disposed of. Issue urgent certified copy of the order as per Rules. A soft copy of this order be immediately communicated to the concerned Court.
