02. 1. Heard learned Counsel for the Petitioner and learned counsel for the State.

The Petitioner is an accused in connection with Kodala P.S Case No.325 of 2025 , pending on the file of learned Additional District and Sessions Judge, Kodala, Ganjam for commission of the offence alleged under Sections 333, 296, 351(2) and 109(1) of BNS, 2023 read with Section 25(1-B)(a) & 27 of Arms Act.

Learned counsel, on instruction, submits that except the present BLAPL, no other bail application of the Petitioner relating to the aforementioned P.S. Case is pending in any other Court.

Being aggrieved by the rejection of his application for bail U/s.483 of the Bharatiya Nagarik Suraksha Sanhita (BNSS) by the learned Additional

District and Sessions Judge, Kodala, Ganjam by order dated 25.03.2026 in the aforementioned case, the present BLAPL has been filed.

The accusation against the present Petitioner is that he caused a gunshot injury to one Bhabini Rauta. Admittedly, the said injured is yet to be examined.

It is submitted by the learned counsel for the Petitioner that six witnesses have been examined and the Petitioner is in custody since 26.05.2025, the Petitioner may be enlarged on bail. 7. Learned counsel for the State as well as informant oppose the prayer for bail. 8. Taking into account the nature of allegations and the submissions made, this Court is not inclined to entertain the bail application of the Petitioner. 9. Liberty is given to the Petitioner to renew his prayer before the learned Trial Court after examination of the injured (Bhabini Rauta). If such an application is moved, same shall be considered on its own merits without being influenced by the earlier rejection or the order passed by this Court.

Accordingly, the BLAPL stands disposed of.
