03. 1. In spite of due service of notice, there is no appearance on behalf of the informant/victim.

Heard learned counsel for the Petitioner and learned counsel for the State.

The Petitioner is an accused in connection with G.R. No.28 of 2025 pending on the file of learned Addl. Sessions Judge-cum-Special Judge (POCSO), Gajapati arising out of Gurandi P.S. Case No.60 of 2025 for commission of offence alleged under Sections 137(2)/64(2)(m) BNS, 2023 read with Section 4/6 of POCSO Act, 2012.

Learned counsel, on instruction, submits that except the present BLAPL, no other bail application of the Petitioner relating to the aforementioned P.S. case is pending in any other Court.

Being aggrieved by the rejection of his application for bail U/s.483 of the BNSS by the learned Addl. Sessions Judge-cum-Special Judge (POCSO), paralakhemundi by order dated 18.02.2026 in the aforementioned case, the present BLAPL has been filed.

It is submitted by the learned counsel for the Petitioner that referring to the deposition of victim, which is taken on record, since the victim has not supported the prosecution case, further continuance of the Petitioner in custody is not warranted. Certified copy of the deposition be kept in a sealed cover.

Learned counsel for the State opposes the prayer for bail.

Considering the tenor of the statement, this Court directs the Petitioner shall be released on bail on such terms to be fixed by the learned Court in seisin.

Accordingly, the BLAPL stands disposed of. U.C.C as per rules.
