Judge, (First Track Special Court), Puri registered for the alleged commission of offence under Section 376(2)(n)/506 of the I.P.C, has filed this petition for his release on bail.

The brief fact of the case is that the Victim has lodged an F.I.R on 02.08.2023 at about 8:35 P.M before the IIC, Chandanpur Police Station alleging inter alia that one Tuku Bhoi in relation her brother-in-law while her wife, namely, Jhumina Bhoi blessed a baby girl in the month of February for which her brother-in-law took her his staying there 10 to 12 days. Taking advantage in absence of his wife, Tuku Bhoi forcibly raped the informant against her will & threatened to kill dire consequences if she narrated the matter anybody. Basing on the aforesaid allegation Chandanpur P.S Case No. 171/2023 dated 02.08.2023 has been registered under Section 376(2)(n)/506 of the Indian Penal Code.

4. Learned counsel for the Petitioner submits that this Petitioner being arrested in the case is in custody since 03.08.2023. In the meantime, charge sheet has already been submitted on 30.09.2023. He has no criminal antecedent to his credit. The victim is the cousin sister of the wife of the petitioner and has been falsely implicated due to family dispute being influenced by the members of the family of the victim girl. In view of all these above, when the Petitioner is a permanent resident of District Puri as also the

question of tampering with the evidence does not arise, he urges for consideration of prayer for grant of bail to the Petitioner

5. Learned counsel for the State vehemently opposes the prayer for bail.

Considering the facts and keeping in view the submission of learned counsel for the Petitioner; further keeping in view the materials on record as those stand against the Petitioner with other surrounding circumstances, this Court is of the view that there is no requirement of keeping the Petitioner inside the custody any further. Accordingly, this Court directs that the Petitioner be released on bail by the Court in seisin over the matter on some stringent terms and conditions with further conditions that:

i. the petitioner shall appear before the local Police Station on 1^st Monday of every month between 10 A.M. to 1.00 P.M. till the conclusion of the trial;
