3. The Petitioner being in custody in connection with G.R. Case No.1866 of 2025 arising out of Aska P.S. Case No.607 of 2025 pending before the Court of learned J.M.F.C(Cog.), Aska registered for the alleged commission of offences under Sections 126(2)/ 115(2)/ 296/ 117(2)/ 109(2)/ 351(3)/ 3(5) of the Bharatiya Nyaya Sanhita, has filed this application for his release on bail.

The brief fact of the case is that on 20.10.2025 at about 11 P.M. the Petitioner and his brother and mother being armed with deadly weapons abused the informant and her husband in filthy languages and threatened her with dire consequences. When the informant and her husband protested the Petitioner and his brother and mother from doing so, they assaulted the husband of the informant by means of a knife. Thereafter, the Petitioner assaulted the uncle-in-law and father-in-law of the informant by means of fist, blows and kicks. Soon after the said incident, an F.I.R was lodged in the local Police Station. Accordingly, on completion of investigation and all the formalities, the Petitioner was taken into custody. The Petitioner has been languishing in custody since 23.10.2025.

5. Learned counsel for the Petitioner contends that the Petitioner is no way connected to the offences alleged against him. He has been entangled in this case due to some previous enmity. He, accordingly, prays for permitting the Petitioner to be released on bail.

6. Learned counsel for the State vehemently opposes the prayer for bail of the present Petitioner. She further submits that such type of offences is not tolerable in a law abiding society. She, accordingly, prays for dismissal of this BLAPL.

7. Considering the submissions made on behalf of both the parties, this Court without going into the merits of the case, directs the court in seisin over the matter to release the present Petitioner on bail in the aforesaid case on some stringent terms and conditions.
