02. 1. Heard learned counsel for the Petitioner and learned counsel for the State.

The Petitioner is an accused in connection with S.T. Case No.28 of 2023 (G.R. Case No.3699 of 2022) pending on the file of learned District and Sessions Judge, Sambalpur, arising out of Burla P.S. Case No.475 of 2022 for commission of offence alleged under Sections 302/34 of I.P.C.

Learned counsel, on instruction, submits that except the present BLAPL, no other bail application of the Petitioner relating to the aforementioned P.S. case is pending in any other Court.

Being aggrieved by the rejection of his application for bail U/s.483 of the BNSS by the learned Sessions Judge, Sambalpur by order dated 25.02.2026 in the aforementioned case, the present BLAPL has been filed.

The prosecution case, in short, is that on 11.09.2022 at 8.34 P.M. informant lodged a written report alleging therein that on 11.09.2022 at about 5.30 P.M. while one Baidyanath Sharma (deceased) (uncle of the informant) was playing with his (informant's) children near the garage of his house, at that time the accused persons came near his garage and abused him in filthy language. It is further alleged that when the said Baidyanath Sharma protested, the accused persons assaulted him by means of deadly weapons like Bhujali and sword. As a result of which, he sustained bleeding injuries on his person and fell on the ground. Furthermore, when the informant, his mother and other persons tried to rescue the deceased, the accused persons also assaulted them, threatened to kill all the family members and left the place. Thereafter, the injured (Baidyanath Sharma) was shifted to VIMSAR for treatment. During the course of treatment, he succumbed to the injuries. Basing upon such report, the aforementioned PS case was registered.

This is the third journey of the Petitioner to this Court.

It is submitted by the learned counsel that the Petitioner was taken to custody on 12.09.2022 and primary ground of seeking release is on account of procrastination of trial.

Learned counsel for the State opposes such prayer for bail referring to the eyewitnesses account of P.Ws.1,6,7 and 8 and that of the doctor P.W.9.

So far as P.Ws.1,6,7 and 8 are concerned, it is submitted by the learned counsel for the Petitioner that no credence can be attached to them since they are related to the deceased.

Perused the status report submitted by the learned Court in seisin indicating that the evidence on the side of the prosecution has been closed and the matter is now posted for defence evidence.

Considering the nature of accusation and the evidence on record and the stage of the trial, this Court is not inclined to entertain this bail application at this stage.

Accordingly, the BLAPL stands disposed of. 13. Learned Court in seisin is requested to conclude the trial as expeditiously as possible.
