Heard learned counsel for the Petitioner and learned counsel for the State.

The Petitioner is accused in connection with S.T. Case No.378/85 of 2024 pending on the file of learned Addl. Sessions Judge, Sambalpur-cum-PO, Designated Court under OPID Act, arising out of Sadar P.S. Case No.142 of 2024 for commission of offence alleged under Sections 302 of IPC.

Learned counsel, on instruction, submits that except the present BLAPL, no other bail application of the Petitioner relating to the aforementioned P.S. case is pending in any other Court.

Being aggrieved by the rejection of their application for bail U/s.483 of the BNSS by the learned Addl. Sessions Judge, Sambalpur by order dated

05.01.2026 in the aforementioned case, the present BLAPL has been filed.

The case of the prosecution, in short, is that on 27.06.2024 at 12.56 P.M. the informant lodged a written report alleging therein that in the morning the informant received an information that on 26.06.2024 in between 9.00 P.M. to 10.00 P.M. his cousin elder father namely Ram Prasad Bag was murdered by his son Dhiren Bag with stick at Budelchinda and when he reached at the place of occurrence, found his elder father lying dead. On the basis of such report, the aforementioned PS case was registered.

It is submitted by the learned counsel for the Petitioner that taking into account the tenor of the deposition of the witnesses P.Ws.1 to 3 examined thus far, further continuance of the Petitioner in custody is not warranted.

Learned counsel for the State opposes such prayer referring to statement of Agasti Bag recorded under Section 183 BNSS. And, the statement of Petitioner recorded under Section 23 of Bharatiya Sakshya Adhiniyam, 2023 (herein after referred to as “BSA”) leading to discovery of the alleged weapon of offence stained with blood.

Considering such submission, this Court is not inclined to entertain this application at this stage.

Accordingly, the BLAPL stands disposed of.

Liberty is granted to the Petitioner to renew his prayer before the learned Court in seisin after examination of Agasti Bag and other witnesses to discovery under Section 23 of BSA.
