1. Heard learned counsel for the Petitioner and learned counsel for the State.

The Petitioner is an accused in connection with S.T. Case No.247/246 of 2025, pending on the file of learned Addl. Sessions Judge, Sundargarh, arising out of Talsara P.S. Case No.80 of 2025 for alleged commission of offences under Section 310(2) of BNS read with Section 25/27 of Arms Act.

Learned counsel, on instruction, submits that except the present BLAPL, no other bail application of the Petitioner relating to the aforementioned P.S. case is pending in any other Court.

Being aggrieved by the rejection of his application for bail U/s.483 of the Bharatiya Nagarik Suraksha Sanhita (BNSS) by the learned Addl. Sessions Judge, Sundargarh by order dated

17.03.2026 in the aforementioned case, the present BLAPL has been filed.

The allegation against the Petitioner is that he along with the co-accused committed dacoity in an organized manner taking away cash of Rs.2,71,000/and mobile phones from the Informant and his four friends by accosting them while they were travelling in an Ertiga car.

It is submitted by the learned counsel for the Petitioner that out of 7 co-accused persons all have been released on bail in as much as by order dated 09.04.2026, the co-accused Akash Kaudi, Bikash Jaypuria and Akshya Kumar Besan @ Akshaya Besan were released on bail in BLAPL Nos.689 of 2026, 712 of 2026 & 1908 of 2026 respectively and it is submitted, on instruction that the said co-accused persons were identified in T.I. parade.

It is further submitted that another co-accused Ashish Rout was released on bail by this Court by order dated 15.10.2025 in BLAPL No.8220 of 2025.

It is stated that except the co-accused Ashish Rout all other co-accused persons were identified in T.I. parade and in this context reference is made to the evidence of P.Ws.3 & 4 which is on record that they have resiled. Hence, it is stated that further continuance of the Petitioner in custody is punitive.

Such submission is opposed by the learned counsel for the State inter alia on the ground that the Petitioner has number of criminal antecedents.

So far as criminal antecedents are concerned, learned counsel for the Petitioner submits that because of such antecedents, the Petitioner has been falsely implicated in the case at hand.

Considering the rival submission, release of the co-accused and evidence of P.Ws.3 & 4 adverted to hereinabove, this Court directs the Petitioner to be released on bail on such terms to be fixed by the learned Court in seisin so as to ensure his presence on each date of trial.
