Instant petitions under Section 482 BNSS are filed for pre-arrest bail of the petitioners in connection with Cyber Crime and Economic Offences, UPD Cuttack P.S. Case No.05 of 2026 corresponding to G.R. Case No.39 of 2026 pending in the file of learned J.M.F.C. (Cog-1), Cuttack on the grounds stated therein.

Gone through the FIR as at Annexure-1.

Learned counsels for the petitioners submit that the names of the petitioners are not mentioned in the FIR at Annexure-1 instead involvement of the main accused, namely, Bablu Nayak is revealed. The submission is that the FIR has been lodged by the IIC, Madhupatna P.S. and the seizures of mobile phones, Debit Cards etc. have taken place and it was shown against the above named accused. The contention is that no transactions alleging loss sustained on account of the mischief committed by the accused persons have taken place, hence, the petitioners should be granted pre-arrest bail, which is seriously opposed by Mr. Lenka, learned ASC for the State.

From the FIR at Annexure-1, is made to suggest that one Badrinarayan Dash is involved and he revealed the name of the principal accused, namely, Bablu Nayak. The allegation in the FIR is that the accused persons opened mule accounts and carried out business in the name of a fake company. The statement of the accused above named recorded under Section 180 BNSS is produced at the time of hearing and the same is gone through. According to the said accused, fake accounts were opened for collection of money for the company and with the money so collected, he purchased expensive articles. As it appears, the accused examined is responsible for the mischief as from him the seizures have been made. A copy of the order in BLAPL Nos.1095 of 2026, 915 of 2026, 1015 of 2026 and 1018 of 2026 dated 24^th February, 2026 is produced to claim that the co-accused persons have been granted bail.

Learned counsel for the State requests for an adjournment to collect the case diary.

But having regard to the nature of allegations revealed in the FIR, it is directed against the principal accused with the alleged involvement of the petitioners, which is claimed on the basis of a disclosure made and as such, there has been release of the co-accused persons in view of the order in the BLAPLs dated 24^th February, 2026, this Court, considering the submissions of learned counsels for both the sides, though not inclined to grant pre-arrest bail to any of them, but is of the view that they should be directed to surrender before the

learned court below for being released with stringent conditions imposed and accordingly, it is ordered.

In the result, the ABLAPLs stand disposed of with the direction as aforesaid. It is further directed that in the event, the petitioners surrender before the court of learned J.M.F.C. (Cog1), Cuttack within a fortnight from today, they shall be released on bail in connection with Cyber Crime and Economic Offences, UPD Cuttack P.S. Case No.05 of 2026 corresponding to G.R. Case No.39 of 2026 subject to them furnishing bail bonds of Rs.50,000/- (Rupees fifty thousand) each with one solvent surety for the like amount each to the satisfaction of the learned court below, which shall be at liberty to impose such other suitable conditions as deemed just and proper in the facts and circumstances of the case.
