Instant petition under Section 482 BNSS is filed for pre-arrest bail of the petitioners in connection with Nayagarh P.S. Case No.127 of 2025 corresponding to G.R. Case No.84 of 2025 pending in the file of learned Additional Sessions Judgecum-Special Judge under POCSO Act on the grounds stated therein.

Gone through the F.I.R. as at Annexure-1. Mr. Tripathy, learned counsel for the petitioners submits that the principal accused is in judicial custody at present. The further submission is that petitioners are the parents and the family members of the principal accused having no role played in the alleged incident. It is claimed that the victim on her own joined the company of the principal accused, whereafter, the report

was lodged. Learned counsel for the State produced the statements of the witnesses recorded under Section 180 BNSS during investigation and the same are also perused. The victim’s version was recorded before a Magistrate under Section 183 BNSS and also during the investigation and on a reading of the same, it is found that she stayed with the principal accused for about two months. Admittedly, the victim is a minor aged about 15 years and her consent is immaterial, but in so far as the petitioners are concerned, they are alleged to have assisted in the elopement of the victim with the principal accused. At present, the victim is at a shelter home and as further informed, she has given a birth to a child begotten through the principal accused. Considering the above facts and the nature of allegations against the petitioners, this Court, recording the objection of learned counsel for the informant, Mr. Amaresh Das, who files the Vakalatnama today taken on record and also learned counsel for the State, though not inclined to grant pre-arrest bail to any of them, but is of the view that for their limited role, they should be directed to surrender before the learned court below for being released with suitable conditions imposed.

4. Accordingly, it is ordered.

In the result, ABLAPL stands disposed of with the direction as aforesaid. It is further directed that upon surrender before the court of learned Additional Sessions Judge-cumSpecial Judge under POCSO Act within a fortnight from today,

the petitioners shall be released on bail in connection with Nayagarh P.S. Case No.127 of 2025 corresponding to G.R. Case No.84 of 2025 subject to them furnishing a bail bond of Rs.30,000/- (Rupees thirty thousand) each with one solvent surety for the like amount each to the satisfaction of the learned court below, which shall be at liberty to impose such other suitable conditions as deemed just and proper in the facts and circumstances of the case besides the following, such as, they shall not cause any harm to the informant in any manner whatsoever, while on bail and co-operate the I.O. in the investigation, till the same is over.
