Instant petitions have been filed under Section 482 BNSS by the petitioners seeking pre-arrest bail in connection with Jagatpur P.S. Case No.729 of 2025 corresponding to G.R. Case No.1864 of 2025 pending in the court of learned J.M.F.C.(R), Cuttack on the grounds stated.

Perused the FIR as at Annexure-1. The case diary along with the medical reports of the injured are made available by learned counsel for the State and the same are gone through.

Learned counsel for the petitioners submits that the alleged incident is an outcome of the political rivalry. The further submission is that no one has received any grievous injury as a result of the alleged incident. Mr. Mulia, learned counsel for the petitioner in ABLAPL No.14892 of 2025 submits that the said accused has one more criminal case registered on the same day. The case diary reveals that one of the accused persons, namely, Priya Ranjan Mohapatra was arrested in connection with the case and he is having nine criminal cases to his credit. The claim is that the other petitioners did not have any past antecedent. A copy of the order in ABLAPL No.13841 of 2025 dated 24^th February, 2026 is produced by Mr. Mulia, learned counsel claiming that the accused, namely, Priya Ranjan Mohapatra is on bail. On a perusal of the medical examination reports, the Court finds that all the victims received simple burn injuries. In fact, in the FIR, it is alleged that bombs were thrown at the other side, as a result of which, the injuries were received by the victims. Recording the objection of the State, release of the co-accused having previous antecedents and circumstances under which the alleged incident said to have taken place revealed from the statements of the witnesses recorded under Section 180 BNSS in course of investigation, this Court, though, not inclined to grant pre-arrest bail to any of them but is of the view that all should be directed to surrender before the learned court below for being released with suitable conditions imposed.

Accordingly, it is ordered.

In the result, the ABLAPLs are disposed of with the direction as aforesaid. It is further directed that in the event, the petitioners surrender before the learned J.M.F.C.(R), Cuttack in connection with Jagatpur P.S. Case No.729 of 2025 corresponding to G.R. Case No.1864 of 2025 within a fortnight from today, they shall be released on bail upon furnishing bail bonds of Rs.25,000/-(rupees twenty five thousand) each with one solvent surety for the like amount each with other conditions imposed as deemed just and proper in the facts and circumstances of the case.
