Instant petition under Section 482 BNSS is filed for pre-arrest bail of the petitioners in connection with Kuakhia P.S. Case No.297 of 2025 corresponding to C.T. Case No.1755 of 2025 pending in the file of learned S.D.J.M., Jajpur on the grounds stated therein.

Perused the F.I.R. as at Annexure-1. A counter F.I.R. has been lodged from the side of the petitioners, a copy of which is at Annexure-3. The alleged incident is narrated in Annexure-1. The petitioners said to have committed the excess and as a result, the victim was disrobed, hence, the offences under Section 74 and 76 BNS. It is informed to the Court that a co-accused person has been released on bail in the meantime by the orders of the learned Sessions judge. A copy of the said order is at Annexure-2. Considering the circumstances and looking to the alleged mischief committed by the petitioners and lodging of the counter F.I.Rs against each other, this Court though not inclined to grant pre-arrest bail to any of them, but

is of the view that the petitioners, notwithstanding the learned Sessions Court’s rejection order i.e. Annexure-4, should be directed to surrender before the learned court below for being released with stringent conditions.

4. Accordingly, it is ordered.

In the result, ABLAPL stands disposed of with the direction as aforesaid. It is further directed that upon surrender before the court of learned S.D.J.M., Jajpur within a fortnight from today, the petitioners shall be released on bail in connection with Kuakhia P.S. Case No.297 of 2025 corresponding to C.T. Case No.1755 of 2025 subject to them furnishing bail bonds of Rs.25,000/- (Rupees twenty-five thousand) each with one solvent surety for the like amount each to the satisfaction of the learned court below, which shall be at liberty to impose such other suitable conditions as deemed just and proper in the facts and circumstances of the case besides the following, such as, they shall co-operate with the I.O. in the investigation and to continue to do so, till its completion.
