Instant petitions have been filed under Section 482 BNSS by the petitioners seeking pre-arrest bail in connection with Narasinghpur P.S. Case No.06 of 2026 corresponding to C.T. Case No.9 of 2026 pending in the court of learned J.M.F.C., Narasinghpur on the grounds stated.

Perused the FIR as at Annexure-1. On a reading of the report, it is made to reveal that for transportation of cattle, the alleged incident took place. The petitioners are alleged of having committed the excess abusing the police officials during and at the time of alleged incident. It is informed to the Court that the petitioners in ABLAPL Nos.1065 and 1066 of 2026 are having antecedents. From the FIR, the Court does not find any injury to have been caused to the police officials on duty. The petitioners in ABLAPL No.714 of 2026 belong to the State of West Bengal and UP. It is submitted that in absence of any such injury caused to the police officials and the allegations are of having abused them while on duty and all the offences are triable by a First Class Magistrate, the petitioners should be allowed to go on bail which is objected to by learned counsel for the State. Considering the above facts and submission of learned counsel for the respective parties, this Court is of the view that the petitioners, some of whom have having criminal antecedents, should be directed to surrender before the learned court below and released with stringent conditions imposed

instead of pre-arrest bail in order to ensure that they do not repeat such nefarious activities after being released.

In the result, all the ABLAPLs are disposed of with the direction as aforesaid. It is further directed that in the event, the petitioners surrender before the learned J.M.F.C., Narasinghpur in connection with Narasinghpur P.S. Case No.06 of 2026 corresponding to C.T. Case No.9 of 2026 within a fortnight from today, they shall be released on bail upon furnishing a bail bond of Rs.30,000/-(rupees thirty thousand) each with one solvent surety for the like amount with other conditions imposed besides the following, such as, all of them shall cooperate the IO in the investigation. It is further directed that the petitioner in ABLAPL No.714 of 2026 being outsiders are to furnish the details of their address statements in the State of West Bengal and UP and their regular movements to the IO and to co-operate him in the investigation as and when necessary.
