Instant petitions have been filed under Section 482 BNSS by the petitioners seeking pre-arrest bail in connection with Banharpali P.S. Case No.263 of 2025 corresponding to C.T. Case No.282 of 2025 pending in the court of learned Civil Judge (Junior Division)-cum-J.M.F.C., Lakhanpur, Jharsuguda on the grounds stated.

Perused the FIR as at Annexure-1. Mr. Mishra, learned counsel for the petitioners submits that the petitioners are firsttime offenders and considering the circumstances under which the alleged incident took place, all of them should be granted pre-arrest bail. It is further submitted that some of the accused persons are under interim protection by this Court’s order dated 9^th January, 2026 as at Annexure-2. Learned counsel for the State submits that the names of the petitioners in ABLAPL No.139 of 2026 are mentioned in the FIR and not the others. Gone through the contents of Annexure-1 and the reason behind the alleged incident. It is claimed that no one has received any serious injury on account of the alleged mischief committed by the accused persons. The injury reports are at Flag-B in ABLAPL No.139 of 2026. On perusal of the same, the Court finds that the victims received simple injuries, as a result of the overt acts committed by the accused persons during the incident. Considering the same and recording the submission of Mr. Mishra, learned counsel for the petitioners that none is having past antecedent and objection of the State, this Court is inclined to direct them to surrender instead of granting pre-arrest bail as has been demanded.

5. Accordingly, it is ordered.

In the result, all the ABLAPLs are disposed of with the direction as aforesaid. It is further directed that in the event, the petitioners surrender before the learned Civil Judge (Junior Division)-cum-J.M.F.C., Lakhanpur, Jharsuguda in connection with Banharpali P.S. Case No.263 of 2025 corresponding to C.T. Case No.282 of 2025 within a fortnight from today, they shall be released on bail upon furnishing bail bonds of Rs.25,000/-(rupees twenty five thousand) each with one solvent surety for the like amount each with such other conditions besides the following, such as, they shall not be involved in similar activities after being released and to co-operate the IO in the investigation as and when summoned.
