Instant petition under Section 482 BNSS is filed for pre-arrest bail of the petitioner in connection with Tantiapal Marine P.S. Case No.146 of 2025 corresponding to G.R. Case No.2319 of 2025 pending in the file of learned S.D.J.M., Kendrapara on the grounds stated therein.

A missing report in respect of the victim was lodged as per Annexure-1 and the same is at the instance of the informant mother. The victim, however, in course of investigation, gave a statement before a Magistrate under Section 183 of BNSS and she alleged nothing adverse against the petitioner. The Court finds that it is a case of elopement involving the victim, a minor aged about 17 years by the time of the alleged occurrence. Considering the same and the victim’s version as made to reveal from the record, the case diary besides statements of other witnesses examined during investigation, this Court even

though not inclined to grant pre-arrest bail to the petitioner, but is of the view that he should surrender before the learned court below for being released with stringent conditions.

In the result, ABLAPL stands disposed of with the direction as aforesaid. It is further directed that upon surrender before the court of learned S.D.J.M., Kendrapara within a fortnight from today, the petitioner shall be released on bail in connection with Tantiapal Marine P.S. Case No.146 of 2025 corresponding to G.R.
