Instant petitions under Section 482 BNSS are filed for pre-arrest bail of the petitioners in connection with Kakatpur P.S. Case No.0128 of 2026 on the grounds stated therein.

Learned counsel for the petitioners submits that there is a counter FIR by the petitioners for the self-same incident. A copy of the said FIR is at Annexure-2 series in the ABLAPLs. It is further submitted that there is a complaint lodged by the villagers and petitioners for use of the road of their village in the transportation of sand causing accident regularly. It is alleged that the dispute is between the villagers and lessee of a sand sairat. It is claimed that there is no injury caused to the informant or anyone else though a case under Section 109 BNS has been registered. It is also claimed that the petitioners are having no antecedents. Considering the allegations in the FIR and the counter FIR lodged by the parties against each other with the claim that no grievous injury caused to anyone, this Court is inclined to direct the petitioners to surrender before the court concerned for being released on bail with suitable conditions though not inclined to entertain their bail plea.

In the result, the ABLAPLs stand disposed of with the direction as aforesaid. It is further directed that in the event, the petitioners surrender before the court seisin over the matter within a fortnight from today, they shall be released on bail in connection with Kakatpur P.S. Case No.0128 of 2026 subject to them furnishing a bail bond of Rs.20,000/- (Rupees twenty thousand) each with one solvent surety for the like amount each to the satisfaction of the learned court below, which shall be at liberty to impose such other suitable conditions as deemed just and proper in the facts and circumstances of the case. It is further directed that the above order shall be given effect to subject to verification and absence of grievous injury caused to the informant or anyone else connected to the case and only if the petitioners do not have any criminal antecedents.
