Instant petition under Section 482 BNSS is filed seeking pre-arrest bail of the petitioner in connection with Belpahar P.S. Case No. 44 of 2026 pending in the file of learned J.M.F.C-I (Cog- Taking), Jharsuguda corresponding to C.T Case No.240 of 2026 on the grounds stated.

Gone through the F.I.R. as at Annexure-1. A copy of the injury report of the victim is submitted to the Court by learned counsel for the petitioner and it reveals him to have received a bruise stated to be simple in nature with an opinion therein that it might have been caused by hard and blunt object. It is informed to the Court that the petitioner does not have any antecedent, hence, a first-time offender. Recorded the objection of Ms. Mohanty, learned ASC for the State with reference to the F.I.R. wherein cash is alleged to have been snatched away

from the informant. But having regard to the fact that the petitioner is stated to have no antecedent and the informant received a simple injury though there is allegation about the assault being carried out by means of a knife, this Court, with the objection of the State being noted down, is of the view that though he is not entitled to pre-arrest bail but instead should be allowed to surrender before the learned for being released with stringent conditions.

4. Accordingly, it is ordered.

In the result, the ABLAPL is disposed of with the direction as aforesaid. In the event, the petitioner surrenders before the court of learned J.M.F.C-I (Cog-Taking), Jharsuguda within a fortnight from today, it is directed that he shall be released on bail in connection with Belpahar P.S. Case No. 44 of 2026 corresponding to corresponding to C.T Case No.240 of 2026 on furnishing a bail bond of Rs.20,000/-(rupees twenty thousand) with one solvent surety for the like amount with such other conditions imposed as deemed just and proper in the facts and circumstances of the case.
