The petitioners are accused in connection with 2(b)CC No. 1 of 2026 arising out of O.R. No.159 JP of 2025-26 registered on the allegation of the alleged commission of offence punishable under section 51 of the Wild Life Protection Act, pending in the court of the learned JMFC, Jagannath Prasad.

Learned counsel for the petitioners, on instruction from the petitioners, submits that, except the present bail applications, no other bail application of the petitioners is pending in any other Court relating to the aforesaid F.I.R.

The prosecution case is that one Smt. Priyanka Palo forest Guard, Bellaguntha Beat on 01.01.2026 at about 9.30 drawn a offence report bearing O.R No. 159 of 2025-2026 alleging therein that on same day while she along with his staffs were performing patrolling duty Suliabandha of village Kebiripalli under Jagannath Prasad Range, found five person were engaged in dressing cleaning, cutting and chopping One blackbuck which comes under schedule-I of the wild animal, by hanging tree. Noticing arrival of forest personnel, all five persons started running from the spot and after short chase, one person namely Rabindra Kumar Parida was nabbed by forest personnel and others could be able to escape from the spot. On being search they found blackbuck head with skin with two horns, deskinned and beheaded carcass with attached four hooks of the blackbuck of weight about 30 kg, intestine of the blackbuck, two numbers of knives, glass bottles in eight numbers, GI wire of 2 kg and five numbers of small sticks from the spot and general allegations are there.

It is brought to the notice of the Court that the co-accused Rabindra Kumar Parida, who was arrested on the spot, moved BLAPL No. 664 of 2026, however on 11.03.2026, he withdrew the same.

In view of the aforementioned and regard being had to the allegations, although I am not inclined to

grant anticipatory bail to the petitioners, however liberty is granted to the petitioners to surrender before the court below and move appropriate application for regular bail. If such application is moved, the same shall be considered by the courts below on the same day.

Learned counsel for the petitioners submits that the petitioners have no criminal antecedents and therefore they are entitled to be admitted to bail. It is open for the petitioners to urge all the grounds before the courts below including the ground of parity.
