Shiba Sing @ Shankarshan Sing Vs State of Odisha

The petitioner is an accused in connection with Nilagiri P.S. Case No. 146 of 2025 corresponding to C.T. Case No.244 of 2025 registered on the allegation of the alleged commission of offence punishable under Sections 126(2)/115(2)/109/351(2)/3(5)of BNS, pending in the Court of the learned SDJM, Nilagiri.

Learned counsel for the petitioner, on instruction from the petitioner, submits that, except the present bail application, no other bail application of the petitioner is pending in any other Court relating to the aforesaid F.I.R.

The prosecution case is that one Maheswar Behera lodged an FIR at Nilagiri Police station on 28.4.2025 alleging therein that he is working ant

poaching squad at Panchalingeswar beat. As per order of superior he and Singre Hembram were going to Gudikhania under Santaragadia Beat areas for night paroling. During duty hour, two hunters namely Madha Sing and Present petitioner came face to face when he try to caught hold to Madhab Sing in the meantime Siba Sing assaulted on his head on the back side of wooden bat country made gun, as a result of which he sustain bleeding injury and the petitioner also gave threatened against dire consequence.

In paragraph-3 of the petition, the petitioner has stated as under:-

“3. That, it is further submitted that one occurrence two cases have been filed against the petitioner in same date one is 2(b)CC No.82 of 2025 arising out of OR No.02k of 202526 pending in the court of learned CJM, Balasore and another is Nilagiri P.S.Case No.146 dt.28.42025 now the petitioner filed anticipatory bail before this Hon'ble Court.”

Learned counsel for the petitioner submits that in 2(b)CC No.82 of 2025, the petitioner has already been granted anticipatory bail by this Court vide order dated 23.06.2025 in ABLAPL No. 6968 of 2025.

The case diary was called for and Ms. S. Devi, learned counsel for the State produced the case diary, wherein the injury report reveals that the injury sustained by the injured are simple in nature.

Learned counsel for the State opposed the prayer for anticipatory bail.

Regard being had to the nature of allegation and the fact that the injuries are simple in nature, I am inclined to grant the petitioner anticipatory bail. Accordingly, it is directed that in the event the Petitioner is arrested, he shall be released on bail by the Arresting Officer, subject to verification of criminal antecedent of similar nature. The release of the Petitioner shall also be subject to the condition that he shall cooperate with the investigation and shall appear before the I.O. as and when his presence is required by the I.O. for the purpose of investigation; he shall not indulge in similar criminal offences while on bail; he shall not threaten/harass/terrorize the informant in any manner whatsoever while on bail; and he shall appear before the trial court on each and every date of posting of the case, if not presented by sufficient cause. Violation of any of the conditions shall entail cancellation of bail.

The ABLAPL is accordingly disposed of.
