3. Learned counsel for the petitioner, on instruction from the petitioner, submits that, except the present bail application, no other bail application of the petitioner is pending in any other Court relating to the aforesaid F.I.R.

The allegation against the present petitioner, in brief, is that on 28.12.2025 at about 9.06 P.M., the complainant appeared before the Police Station and lodged a written report alleging therein that, for the last three months, one Sushil Bargarti (the present petitioner) had been threatening to kill his son. It is further alleged that on 27.12.2025 at about 7.30 P.M.,

while the complainant’s son was returning from his shop on a scooty, the petitioner assaulted him with an iron rod with an intention to kill him and thereafter fled away from the spot. Due to the assault, the victim fell from the scooty and sustained bleeding injuries on his head. Hearing the hulla, the complainant along with his wife rushed to the spot, rescued their son, and shifted him to Padampur Hospital for treatment. After primary treatment there, he was shifted to Bargarh Hospital for better treatment. Hence, the F.I.R.

5. Vide order dated 22.04.2026, learned counsel for the State was directed to produce the case diary. Pursuant thereto, the learned counsel for the State has produced the same, which reveals that the victim

sustained multiple injuries on his head. Hence, he opposes the prayer for anticipatory bail.

6. Regard being had to the nature of allegations against the petitioner, this Court is not inclined to grant the petitioner anticipatory bail. However, it is open for the petitioner to surrender and move application for regular bail before the trial Court. In the event the petitioner surrenders and moves application for bail, it is expected that the learned Courts below shall decide the bail application on its own merit on the same day.
