Heard learned counsel for the petitioner and State.

Instant petition has been filed under Section 482 BNSS by the petitioner seeking pre-arrest bail in connection with Kodala P.S. Case No.283 of 2025 corresponding to G.R. Case No.234 of 2025 pending in the court of learned J.M.F.C., Kodala on the grounds stated.

Gone through the FIR as at Annexure-1. Learned counsel for the petitioner submits that the father of the present accused was the assailant and he has been granted bail by the order of the learned Sessions Court. A copy of the order dated 29^th May, 2025 in BA No.75 of 2025 of the court of learned Additional Sessions Judge, Kodala, Ganjam in respect of the father of the petitioner is produced in support of such claim. A copy of the chargesheet is also produced to submit that the petitioner has not been chargesheeted for the offence under

Section 109(1) BNSS instead, it is against the co-accused father. Recorded the objection of the State. Learned counsel for the petitioner submits that the victim has received a grievous injury, But, the co-accused father is responsible for the alleged injury and therefore, he is chargesheeted and not the petitioner and considering the same and submissions of learned counsel for the respective parties, this Court, though not inclined to grant him pre-arrest bail but is of the view that he should be directed to surrender before the leaner court below for being released with suitable conditions imposed.

4. Accordingly, it is ordered.

In the result, the ABLAPL is disposed of with the direction as aforesaid. It is directed that in the event, the petitioner surrenders before learned J.M.F.C., Kodala in connection with Kodala P.S. Case No.283 of 2025 corresponding to G.R. Case No.234 of 2025 within a fortnight from today, he shall be released on bail upon furnishing a bail bond of Rs.30,000/-(rupees thirty thousand) with one solvent surety for the like amount with such other conditions imposed as deemed proper in the facts and circumstances of the case.
