Petitioner in this Writ Petition prays for the following

In the facts and under the circumstances mentioned above, it is humbly prayed that this Hon'ble Court may graciously be pleased to:

i) declare that the disqualification of the petitioner in the technical bid as per minutes of the tender call meeting dated 26/07/2024 under Annexure-1 pursuant to the tender call notice vide No.1285 dated 10/07/2024 as illegal and bad in law and,

ii) set aside/quash the acceptance of the bid of Opp. Party No.4 as per the Price bid opening summary dated 03/10/2024 under Annexure-4,

iii) Issue appropriate direction to the opp. Parties, more particularly, the Opp. Party No.3 to evaluate the bid of the Petitioner along with other bidders as per the tender call notice.

And pass such order/orders, direction/directions as this Hon'ble Court deems fit and proper in the facts and circumstances of the case.

Mr. Rath, learned counsel for the Petitioner submits that the in the meantime, financial bid has already been opened and Opposite Party No.4 has been adjudged as successful bidder, who quoted the lowest price. He, therefore, submits that the Writ Petition becomes academic. As such, he prays for withdrawal of the same.
