2. The Petitioner has filed this Writ Petition challenging

the action of the Opposite Parties/Bank in not providing the No Objection Certificate even after final settlement of the loan account bearing account No.092306000011291 and in not handing over the original title deeds of the Petitioner which was initially mortgaged with the bank at the time of sanctioning of the loan amount as well as in not providing the refund of the excess amount deposited

by the Petitioner as per the instructions of the Opposite Parties/Bank.

3. Heard learned counsel for the Parties.

Learned counsel for the Petitioner submits that he has taken loan of Rs.8,00,000/- (Rupees Eight Lakhs Only) from the Opposite Parties/Bank which was to be repaid by the Petitioner within 15 years on equal monthly installments till final closure of the loan account. Due to some financial constraints, the account of the Petitioner has become NPA on 20.07.2024. Thereafter, in order to clear the dues, the Petitioner deposited the loan amount in the said housing loan account and subsequently, he has cleared the entire housing loan amount. Despite clearing of the entire loan amount, the Opposite Parties/Bank is not issuing No Objection Certificate to the Petitioner. Hence, the Petitioner is constrained to approach this Court.

5. Considering the facts and submissions made, the Petitioner is directed to approach the Opposite Parties/Bank for closure of the loan account. In such event, the Opposite Parties/Bank shall settle the loan account of the present Petitioner by asking for the

outstanding money if any and issue the No Objection Certificate at the earliest possible.

6. Accordingly, the Writ Petition is disposed of.
