“In the circumstances stated above, it is humbly prayed that this Hon'ble Court may graciously be pleased to issue a Rule NISI in the nature of Mandamus and / or any other appropriate writ / writs, call for the records, call upon the Opp. Parties to show cause as to why-

(2) The Inspection Report dated 01.05.2024 vide Annexure-5 shall not be set aside and the Opp Parties be directed to conduct the

inspection again by taking into consideration the area / premises of the building being utilised by the Hospital of the petitioners. And if the Opp. Parties fail to show cause or show insufficient cause make the said Rule Nisi absolute;”

Learned counsel for the Petitioner submits that the Petitioner No.1 is a private limited company and a hospital having 60 beds in the building with B+G+3 floors over the Plot No.640/13498, Khata No.2414/11039 of Mouza-Bargarh Town. He further submits that the Opposite Party No.2/The Deputy Fire Officer, Sambalpur Circle, Sambalpur has not considered the representation dated 27.12.2024 for issuance of Renewal of Fire Safety Certificate. He further submits that the Opposite Party Nos.2 and 3 have inspected the building premises of the hospital on 01.05.2024 and a few days thereafter the Inspection Report was uploaded to the website of the Opposite Party No.1 wherein the Petitioner came to know that requesting for renewal of Fire Safety Certificate has not been allowed due to some shortfalls.

Learned counsel for the Petitioner further contends that the defects/shortfalls indicated by the Fire Safety Department have already been removed by the Petitioner during the pendency of

this Writ Petition.

Department, the Petitioner should approach afresh to the concerned authority for issuance of Fire Safety Certificate.

In such view of the matter and considering the submission

made by the learned counsel for the parties, this Court directs the Petitioner to approach the concerned authority by way of a fresh application for renewal of Fire Safety Certificate along with required documents. In such event, the Authority shall consider the same and take a decision in the matter in accordance with law within a period of fifteen days from the date of filing of the application. The decision of the Authority shall also factor into the tone and tenor of Sarbakhyama Yojana floated by the Government on 17^th March, 2025.

The Writ Petition is, accordingly, disposed of.
