During the course of hearing, learned counsel for the Opposite Party No.6/State Pollution Control Board submits that the Environmental Clearance is pending before the Government of India, Ministry of Environment and Forest and Climate Change. Hence, the present Writ Petition is premature.

In such view of the matter, this Court is of the view that since the Environmental Clearance is pending before the Government of India, Ministry of Environment and Forest and Climate Change, this Court is not inclined to entertain this Writ Petition. However, if the Petitioner is affected by the order to be passed by the Government of India, Ministry of Environment and Forest and Climate Change, the Petitioner is free to approach this Court afresh by filing a Writ Petition with a solid cause of action.

Accordingly, the Writ Petition is dismissed being premature.
