07.11.2025 Order No. 05. 1. This matter is taken up through Hybrid Arrangement (Virtual/Physical) Mode.

2. Heard learned counsel appearing for the Parties.

3. The present Writ Petition has been filed inter alia with the following prayer:-

“In view of the aforesaid facts and circumstances, it is therefore humbly prayed that this Hon'ble Court may graciously be pleased to admit the writ petition and issue a Rule Nisi calling upon the Opp. Parties to show cause as to why:

i) The order dated 08.03.2021 issued by the Opp. Party No.3 under Annexure-11 shall not be set aside/quashed.

ii) The Opp. Parties more particularly the Opp. Parties No. 2 shall not be directed to sanction the family pension of the deceased pensioner in favour of the petitioner within a stipulated period.

iii) The action of the Opp. Parties in not sanctioning family pension shall not be declared as illegal, arbitrary and no nest in the eye of law,

And further may be pleased to pass any other order "(s)/direction(s) as deemed fit and proper, And for the

said act of kindness, the appellant as in duty bound, shall ever pray.”

4. It is contended that the ground on which the Petitioner’s claim has been rejected vide the impugned order dtd.08.03.2021 under Annexure-11 is no more sustainable in view of the order passed by this Court on 25.09.2025 in W.P.(C) No.25030 of 2022.

5. Learned counsel appearing for the Opposite Parties also fairly contended that the issue is squarely covered by the aforesaid order.

6. Considering the submissions made, this Court while quashing the order under Annexure-11 dispose of the Writ Petition in the light of the order dtd.25.09.2025 so passed in W.P.(C) No.25030 of 2022.

7. Accordingly, the Writ Petition stands disposed of.
