1. In view of our order dated 02.09.2025, application for amendment has been filed. In the amendment application the consolidated cause title has been annexed that indicates Sushree Institute of Technical Education (SITE) as the petitioner.

2. Prayer for amendment is allowed. Consolidated cause title is accepted and taken on record. The case brief shall be updated with the amended cause title along with the scanned copy.

Though the matter is listed for orders, is taken up for fresh admission and hearing, in view of the urgency as submitted by the learned counsel for the petitioner as the institution is challenging rejection of ‘renewal of No Objection Certificate’. Though we are disposing of the matter at the stage of admission, we have not issued notice to the opposite parties no.4 and 5 in view of the fact that the order that would be passed would no way impact the said opposite parties and the action of the opposite parties no.2 and 3 is questioned regarding refusal of grant of ‘renewal of NOC’.

Learned counsel for the petitioner submits that the renewal of the NOC applied by the petitioner-institution for Auxiliary Nurse Midwifery (ANM) course in 40 seats and M.Sc.(Nursing) course 25 seats for the educational year 2025-2026. The name of the petitioner-institution finds place at Sl. Nos.2 and 4 in the office order dated 06.08.2025 issued by the opposite party no.3-Council notifying the rejection.

5. It is submitted by the learned counsel for the petitioner that the ground of the rejection of renewal of the ‘NOC’ is ‘production of fake certificate’ indicating fire safety of the building used by the institution. It is submitted that in the meanwhile, ‘fire safety

certificate’ has been obtained by the institution from appropriate authority.

Without expressing any opinion regarding the claim of the petitioner-institution, we observe that the petitioner-institution shall produce the fire safety certificate obtained from the appropriate authority before the opposite party no.3-authority, who shall consider the same in accordance with law. It is submitted by the learned counsel for the petitioner that they have already submitted the certificate before the authority. In that event, the authority shall act upon the same and take decision in accordance with law. We do not express any opinion regarding authenticity of any such certificate that would be produced.

7. The writ petition is disposed of with the above order.

Since the admission process is continuing and is supposed to be over by 30.09.2025 the authority shall act upon the website copy of this order obtained from official website and take a decision in accordance with law at the earliest.
