1. The petitioners, villagers of Badamulabasanta under Pattamundai Tahasil in the district of Kendrapara, filed the present writ petition in the nature of Public Interest Litigation, wherein it is alleged that the opposite party nos.8 to 11 encroaching upon the Government land pertaining to Plot No.1098, Khata No.385 having area Ac.0.01 decimal under Badamulabasanta under Pattamundai Tahasil in the district of Kendrapara carry on their business.

2. Having sought for instruction from the Tahasildar, Pattamundai, learned Additional Government Advocate appearing for the State informed that said Tahasildar caused enquiry with respect to the averments made in the instant writ petition through the Revenue Inspector.

2.1. The enquiry report forming part of communication made to the learned Advocate General as placed before this Court by the learned Additional Government Advocate reveals that the Revenue

Inspector on spot verification of the aforesaid land found that the encroachers are no more carrying on business over the plot in question and it is also found that the said piece of land is free from encroachment.

3. Having considered such submissions and perused the report submitted by the Tahasildar, Pattamundai, it seems the issue raised by the petitioner in the instant writ petition is redressed. Therefore, keeping this writ petition pending shall not sub-serve any fruitful purpose. The writ petition, hence, stands disposed of with an observation that the authority concerned shall keep vigil over the Government plot(s) so as to prevent any future encroachment.
