1. This matter is taken up through hybrid mode.

Petitioner in this writ petition prays for a direction to the Collector, Deogarh-Opposite Party No.2 to consider and dispose of the representation under Annexure-3 and grant higher compensation in favour of the Petitioner for acquisition of his land pertaining to Plot No.13/119 (Gharabari) under Khata No.25/9 of Mouza-Markandpur under Barkot Tahasil in the district of Deogarh.

It is submitted by Mr. Mishra, learned counsel for the Petitioner that although the estimated value of the land and structure over the acquired land was Rs.18,86,464/-, but, the Petitioner was awarded with a meagre amount of Rs.2,93,187/-. An amount of Rs.2,63,868/- was disbursed in favour of the Petitioner deducting 10 per cent TDS. Hence, he has made a representation to the Collector, Deogarh on 27^th January, 2025 for enhancement of compensation in terms of the estimation made under Annexure-2.

In course of hearing, Mr. Mishra, learned counsel for the Petitioner submits that the Petitioner has an efficacious remedy under Section 3-G (5) of the National Highways Act, 1956 to move an application to the Collector, Deogarh for enhancement of the compensation. In view of the above, he prays for withdrawal of the writ petition to avail such remedy.

Mr. Pattnaik, learned Additional Government Advocate does not have any objection to the same.

Hence, this writ petition is disposed of as withdrawn with an observation that if the Petitioner files an application under Section 3-G(5) of the Act within a period of two weeks hence before the Collector, Deogarh enclosing the relevant documents and providing required information, the same shall be considered in accordance with law.
