02. 1. This matter is taken up through hybrid mode.

Petitioner in this writ petition seeks to assail the order passed by the Assistant Settlement Officer, Khurda Camp at Rental Colony, Bhubaneswar-Opposite Party No.3 directing to record the lease hold property in favour of the Government.

The Petitioner is a subsequent purchaser. It is submitted by Ms. Panda, learned counsel for the Petitioner that the final ROR under Section 12-B of the Odisha Survey and Settlement Act, 1958 (for brevity ‘the Act’) has already been published in the meantime and the Petitioner has a remedy under Section 15(b) of the said Act to assail the correctness of the entrees in the final ROR. Hence, she prays for withdrawal of the writ petition to avail the remedy under Section 15(b) of the Odisha Survey and Settlement Act, 1958 by filing properly constituted revision.

In view of such submission, the writ petition is disposed of as withdrawn with an observation that in the event, the Petitioner files revision under Section 15(b) of the Odisha Survey and Settlement Act, 1958 before the Member, Board of Rvenue, the same shall be considered in accordance with law.
