The Petitioner, in this writ application, seeks for a direction to the Opposite Parties to allot a shop room in the market complex constructed near Kacheri Bazar Chhack, Nilagiri.

Mr. Nayak, learned counsel for the Petitioner submits that Sarbajanina Puja Committee, Nilagiri who was a member of the Committee for allotment of shop room had recommended the name of the Petitioner. But subsequently Nilagiri Jagadhatri Puja Committee and Nilagiri N.A.C. Puja Committee submitted two other lists of persons for allotment of shop rooms in the aforesaid market complex. It is his submission that Sarbajanani Puja Committee was also a member for selection of persons to be

allotted with shop rooms in the aforesaid market complex. But, the case of the Petitioner was not taken into consideration for allotment. Thus, a representation was submitted by the Petitioner and other similarly situated persons for consideration of their names for allotment of shop rooms. Said representation was submitted in terms of the notice No.1349 dated 12.06.2025 issued by the Executive Officer, N.A.C., Nilagiri. The said representation has not yet been considered. Hence, this writ application has been filed for the aforesaid relief.

From the averments made in the writ petition and documents filed, more particularly Annexure-4, it is apparent that the Secretary, Sarbajanina Durga Puja Committee, Nilagiri, which recommended the name of the Petitioner, was not a member of the Committee for allotment of shop rooms. It is, however, submitted by Mr.Nayak, learned counsel for the Petitioner that a representation pursuant to the notice under Annexure-5 was filed for consideration of the case of the Petitioner.

In that view of the matter, this Court without expressing any opinion on the merit of the case of the Petitioner disposes of the writ petition with an observation that the Petitioner, if so advised, may pursue his representation, if any, filed for consideration.
