Mr. Mishra, learned Senior Advocate submits that the Petitioner being the successful bidder executed an agreement on 16^th March, 2023 pursuant to Request for Proposal under Annexure-1. The term of the agreement was for a period of three years. Before expiry of the period of three years, Annexure-8 was issued by the Chief District Medical and Public Health Officer-cum-District Mission Director, Bhadrak inviting fresh tender for Security Services under NIRMAL. It was also stated therein that agreement with the existing Service Providers may be extended for a period of three months beyond December, 2023. Thus, the agreement executed in favour of the Petitioner was prematurely determined on 31^st March, 2024.

Mr. Sahoo, learned Additional Standing Counsel, however, submits that to strengthen the security system in the Hospitals under NIRMAL Scheme, fresh tenders were floated as

per the policy decision of the State Government. Further, vide letter dated 22^nd June, 2023, the Directorate of Health Services, Odisha instructed all the Chief District Medical and Public Health Officers of the State to intimate all the existing Service Providers for termination of their MoUs/Contract within six months (latest by December, 2023). Accordingly, Annexure-8 was issued. He, however, prays for an adjournment to take instruction with regard to the provisions, if any, for duly compensating the existing Service Providers like the Petitioner for premature/termination of their agreement.
