Pursuant to order dated 2^nd July, 2025, Mr. S.N. Biswal, learned Additional Standing Counsel placed on record the written instructions imparted by the Deputy Director of Estates-cum-Joint Secretary to Government, General Administration and Public Grievances Department, Government of Odisha, Bhubaneswar vide Letter No. 24658/CA, Bhubaneswar dated 22^nd July, 2025. The same is taken on record.

The writ application has been filed to direct the Director of Estate-cum-Ex-Officio Additional Secretary to Government, General Administration and Public Grievances Department, Bhubaneswar-Opposite Party to accord permission to the Petitioner to alienate the leasehold property pertaining to Plot No.74 (SCR) measuring 20’x31’, Unit-III, Mouza- Kharavela Nagar, Bhubaneswar (for brevity ‘the case land’) due to legal necessity of the petitioner.

It is submitted by Mr. J.K. Khuntia, learned counsel for the petitioner that the case land was leased out in favour of one Dwarika Prasad Sharma and a lease deed was executed in his favour. Subsequently, the Record of Right was also prepared in his name. After obtaining necessary permission from the G.A. Department, said Dwarika Prasad Sharma alienated the case land in favour of Petitioner. Accordingly, Record of Right under Annexure-1 was prepared in the name of the Petitioner.

Subsequently, the Petitioner for his legal necessity filed an application before the Opposite Party on 30^th July, 2024 to accord permission for alienation of the case land in favour of Smt. Sushama Jena. The said application is still pending with the Opposite Party. As no step was taken for consideration of such application for grant of permission, the Petitioner also sent a reminder on 3^rd October, 2024. In spite of the same, the Director of Estate-cum-Ex-Officio Additional Secretary to Government, General Administration and Public Grievances Department, Bhubaneswar has not taken any step for grant of permission for alienation of the leasehold property in favour of Smt. Sushama Jena. Thus, the Petitioner finding no other alternative has filed this writ application.

Considering the submissions made by the learned counsel for the Petitioner, this Court vide order dated 2^nd July, 2025 directed the learned State Counsel to take instruction in the matter.

A copy of the written instruction, as aforesaid, is submitted by Mr. S.N. Biswal, learned Additional Standing Counsel in which

two months time has been sought for to take a decision on the letter of the Petitioner requesting for grant of permission for alienation of the case land.

In view of the written instruction as aforesaid, this Court without expressing any opinion on the merits of the case of the petitioner, disposes of the writ application with a direction to the Director of Estate-cum-Ex-Officio Additional Secretary to Government, General Administration and Public Grievances Department, Bhubaneswar-Opposite Party to take a decision on the application filed by the Petitioner for grant of permission as expeditiously as possible preferably within a period of two months from the date of production of the certified copy of the order and communicate the same to the Petitioner forthwith.
