2. It is submitted at the Bar that the parties have resolved their disputes and differences amicably and to the said effect, a Joint Affidavit has been filed on 12.11.2025, which is at Flag-B of the record.

3. Paragraph Nos.6 to 9 of the said Joint Affidavit, being relevant, are reproduced below:-

“6. That the deponents have decided to lead independent lives and have taken a conscious decision to seek for a decree of divorce on mutual consent by filling a joint petition praying for dissolution of Marriage by mutual consent under Section 13 B of Hindu Mariage Act/Section 28 of the Special Marriage Act before the Learned Trial Court within 10 days of disposal of the present writ petition.

7. That the petitioner has offered to pay an amount of Rs. 9,00,000/-(Rupees Nine Lakhs only) to the Opp. Party towards permanent alimony. Out of the said amount, Rs. 3,00,000/- (Rupees Three Lakh Only) shall be paid by the Petitioner (husband) to the Opp. Party (wife) at the time of the filing of the petition for mutual divorce. The rest of the amount shall be

paid by the Petitioner (husband) to the Opp. Party (wife) in three (3) instalments of Rs. 2,00,000/(Rupees Two Lakhs only) each before the final date of hearing of the said case of divorce by mutual consent before the learned Trial Court. The Opp. Party will not claim any further amount towards permanent alimony or maintenance under any law whatsoever.

8. That the deponents have agreed to withdraw the cases filed against each other before the Courts below during the pendency of the mutual divorce. Neither of the deponent shall have any further subsisting claim from the other after the disposal of the divorce by mutual decree.

That both the parties have mutually agreed to extend full cooperation to each other at the time of filing of the said petition for divorce by mutual consent before the Learned Judge, Family Court, Rourkela without any reservation, objection or initiation of future litigation against each other in respect of the present matrimonial dispute and it is further agreed by the deponents that upon filing of the said petition for mutual divorce before the learned Judge, Family Court, Rourkela, the payment of monthly interim maintenance by the Petitioner to the Opp. Party shall stand discontinued.”

4. Parties are directed to act in terms of the Joint Affidavit, which has been detailed above.

5. Accordingly, the writ petition stands disposed of.
