This writ petition under Articles 226 and 227 of the Constitution of India, 1950 has been filed by the petitioner praying for directing the Opp. Parties for uploading the R.o.R. vide Khata No.474/2407 containing plot No.516/1725/4070 under Annexure-5 of Mouza-Patia in the Bhulekh land records web portal of Government of Odisha and to receive the rent (land revenue) of the said Khata No.474/2407 from the petitioner and to correct the land records of Khata No.493, as the R.o.R of Khata No.474/2407 has been prepared by the Opp. Parties in the name of the petitioner and he (petitioner) is in possession over the properties covered under Khata No.474/2407.

2 . I have already heard from the learned Senior Counsel for the petitioner and the learned Addl. Standing Counsel for the State.

3 . Undisputedly the R.o.R. vide Khata No.474/2407 in Mouza- Patia (Annexure-5) stands in the name of the petitioner and the same has been prepared by the Tahasildar, Bhubaneswar (Opp. Party No.2).

There is no material in record on behalf of the Opp. Parties to show about the correction or cancellation of the said R.o.R vide Khata No.474/2407 (Annexure-5) from the name of the petitioner.

When the unchallenged/undisputed R.o.R vide Khata No.474/2407 prepared by the Tahasildar, Bhubaneswar (Opp. Party No.2) stands in the name of the petitioner, then, it is the duty of the Opp. Party No.2 to upload the said R.o.R. vide Khata No.474/2407 in Bhulekha land records web portal of the Government of Odisha and to receive the rents in respect of the properties of the Khata No.474/2407 through their local R.I. Kalarahanga (Opp. Party No.3) from the petitioner and issue the rent receipts.

It appears from the notification vide RDM-CHS-POLICY00112018 L. No.45075/R&DM, Dt.15.12.2018 communicated to the Secretary Board of Revenue, Orissa, Cuttack and all Collectors of the State that, all the R.o.Rs, those has been issued to the recorded tenants (RT), if the same are not available in Bhulekha Website, the same are to be entered in

the Bhulekha Software in the LRMS Software of each Tahasil/Revenue Office.

5 . When the R.o.R vide Khata No.474/2407 (Annexure-5) stands in the name of the petitioner and when as per the aforesaid notification of the Government of Odisha vide RDMCHS-POLICY-0011-2018, L. No.45075/ R & DM, Dt.15.12.2018, all the R.o.Rs in the name of the recorded tenants should be entered into Bhulekha Software of each Tahasil Office, then at this juncture, there is no justification under law to disallow the prayer of the petitioner to direct the Opp. Parties for uploading the land particulars of Khata No.474/2407 of the petitioner in the Bhulekha land records web portal of the Government of Odisha and to direct the Opp. Party Nos.2 and 3 to receive the rent of Khata No.474/2407 (Annexure-5) from the petitioner and to issue the rent receipt to him (petitioner).

For which, the writ petition filed by the petitioner is to be allowed.

6 . In result, the writ petition filed by the petitioner is allowed.

The Opp. Parties including the Tahasildar, Bhubaneswar (Opp. Party No.2) are directed to upload the land particulars of Khata No.474/2407 (Annexure-5) in Mouza-Patia of the petitioner in the Bhulekha land records web portal of the Government of Odisha within a week from the date of communication of this Judgment and to receive the

and to issue the rent receipts to him (petitioner).
