Order No. 06. The grievance of the petitioner is as to long pendency of his application dated 30.11.2023 at Annexure-2 for change of land user. The said application is made to the Chairman of Orissa Industrial Infrastructure Development Corporation.

Learned counsel for the petitioner submits that where land user conversion is sought for, a decision on the request has to be taken on a war footing so that the purpose of allotment of the land in question is not defeated. He also submits that OCACA has already granted approval vide letter dated 26.12.2023, a copy whereof avails at Annexure-7.

Learned counsel appearing for answering OPs, namely, OP Nos.2 to 5 submits that there was a decision taken by the State Level Single Window Committee on 23.08.2024 in similar matters and therefore, now the OCACA having given the approval, there would be no difficulty in considering the subject application in accordance with law, if all

contentions are kept open and a time line is also prescribed. He also tells that earlier the IT Policy was not finalized although, now it has been vide Annexure-8 dated 22.06.2023.

In the above circumstances, petition is disposed off directing OP No.4 to take a decision on the subject representation. Time for consideration and informing the petitioner of such consideration is eight (8) weeks. All contentions are kept open.

It is open to solicit any information or document from side of the petitioner, as are required for due consideration of the subject representation; however, in that guise delay shall not be brooked. If delay is brooked, OP No.4 may be directed to pay heavy cost in thousands of rupees. It hardly needs to be stated that the consideration should take place in the light of the consideration made in favour of similarly circumstanced persons.
