This application has been filed by the learned counsel appearing for the Petitioner for transfer of Civil Proceeding under Section 24 of the Code of Civil Procedure, 1908 bearing C.P. Case No.20 of 2017 from the Court of the learned Judge, Family Court, Jajpur to the Court of the learned Judge, Family Court, Keonjhar.

This Court vide order dated 02.01.2025 directed the Registry to call for a report urgently from the Court below regarding the present status of C.P. No.20 of 2017.

Today, when the matter was taken up, Office Note shows that status report vide Letter No.77, dated 27.01.2025 was received from the Office of the learned Judge, Family Court, Jajpur, which reads as under:-

“In pursuance of Memo No.1488 TRP(C) 164 of 2018 of Hon’ble High Court of Orissa, I am to submit that CP 20/2017 was instituted by the petitioner-husband U/s9 of

Hindu Marriage Act for institution of conjugal right. After examining of three witnesses on behalf of the petitioner and the cross examination having been conducted by the OP, the evidence of the petitioner was closed giving opportunity to adduce evidence to the OP. But the OP did not give the evidence and after assessment of evidence of the petitioner, the proceeding culminated in contested judgment by this Court on 23.07.2018 allowing the suit on contest for restitution directing the respondent to join the society of petitioner forthwith and thus the proceeding was concluded with contested judgment.”

At this stage, learned counsel appearing for the Petitioner, by filing a memo in Court today, submitted that the Petitioner may be permitted to withdraw this transfer petition. The said memo is taken on record.

Faced with aforesaid situation, the transfer petition stands disposed of as withdrawn.
