This application has been filed by the learned counsel for the Petitioner under Section 24 of the Civil Procedure Code, 1908 for transfer of Civil Proceeding Case No.15 of 2018 from the Court of the learned Judge (Senior Division), Jagatsinghpur to the Court of the learned Judge, Family Court, Bhubaneswar.

This Court vide order dated 03.01.2025 passed the following

“2. Learned counsel for the Opposite Party is absent on call.

3. Learned counsel for the Petitioner prays for an adjournment to ascertain the present status of C.P. No.15 of 2018, pending in the Court of Civil Judge, Senior Division, Jagatsinghpur.

4. Prayer for adjournment is allowed.

5. The matter be listed in the week commencing from 27^th January, 2025.

6. In the meantime, office is also directed to call for a report urgently from the Court below regarding the present status of C.P. No.15 of 2018.”

Today, when the matter was taken up, Office note shows that the status report vide Letter No.67, dated 24.01.2025 was received from the Office of the learned Judge, Family Court, Jagatsinghpur, which reads as under:-

“Inviting reference to the subject sited above, I am to state that the aforesaid Civil Proceeding No.15 of 2018 was dismissed for default vide order dtd.18.1.2023.”

At this stage, learned counsel appearing for the Petitioner furnished a memo in Court today seeking permission to withdraw this petition with liberty to file a fresh transfer petition if cause of action shall arise in future. The said memo is taken on record.

Faced with such situation, the transfer petition, accordingly, stands disposed of as withdrawn with liberty as sought for.
