1. Heard learned counsel for the Parties.

By means of this application, the Petitioner seeks the intervention of this Court for a direction to the Opposite Party No.2 for a proper investigation and alternatively to get the investigation conducted through an independent and impartial agency.

Pursuant to the complaint of the Petitioner, Bharatpur P.S. Case No.589 of 2023 was registered and investigation commenced. Vide order dated 25.06.2025 of this Court, the DCP, Bhubaneswar was directed to file an affidavit explaining the detail progress in the investigation. The DCP, Bhubaneswar in defiance to the direction of this Court preferred not to file any affidavit. This is viewed seriously by this Court. It is directed that the learned counsel for the State

shall communicate the concern of this Court to the DCP, Bhubaneswar for his future guidance in as much as such defiance of the order of this Court, without a plausible explanation, amounts to contempt.

The IIC of Police, Bharatpur Police Station, however, has furnished the report wherein it reveals that subsequent to the investigation in the matter and as also admitted by the learned counsel for the Petitioner a sum of Rs.5,00,000/(Rupees Five Lakh Only) has already been transferred by the culprits to the account of the Petitioner. Further, upon completion of the investigation, the Final Form has already been submitted before the jurisdictional Magistrate against the accused persons vide FF No.408/2025 dated 26.07.2025, implicating them in the offence under Section417/420/506/34 of IPC.

In view of the above submission, no specific direction is required to be passed herein.

A free copy of this order be supplied to the learned counsel for the State for communication to the DCP, Bhubaneswar for information and guidance.
