Orissa High Court (Dr. S.K. Panigrahi, J.), W.P.(C) No.1373 of 2025 with CONTC No.801 of 2025, judgment dated 20.06.2025: The demolition of the petitioners' 'Gosthigruha' community structure standing on Gochar (grazing) land at Mouza Balipur, Tahasil Athagarh, District Cuttack, carried out at 10:00 AM on 14.12.2024 — barely seventeen hours after a demolition notice was affixed, hours after the Sub-Collector reserved his decision in Encroachment Appeals Nos. 26 & 27 of 2024, and in open defiance of this Court's interim orders dated 29.11.2024 and 13.12.2024 restraining eviction — was held unlawful. None of the mandatory safeguards prescribed by the Supreme Court in In Re: Directions in the matter of demolition of structures, W.P.(C) No. 295/2022 (15-day show cause notice, reasoned order, appellate opportunity, videography, portal upload) was fulfilled; those safeguards are enforceable mandates and minimum constitutional thresholds, not aspirational guidelines. Forcible dispossession without due process violates Article 300-A and is an affront to basic human rights (drawing on N. Padmamma v. S. Ramakrishna Reddy, (2008) 15 SCC 517, and JilubhaiNanbhaiKhachar v. State of Gujarat, 1995 Supp (1) SCC 596); acting while an order stands reserved is, in substance, an attempt to outpace the law and cannot be condoned; the episode was characterised as 'bulldozer justice', with public-accountability principles drawn from Delhi Airtech Services Pvt. Ltd. v. State of U.P., (2011) 9 SCC 354. Writ petition allowed: public law compensation of ₹10,00,000 assessed having regard to reconstruction cost, loss suffered and gravity of administrative misconduct — ₹2,00,000 recoverable from the Tahasildar concerned through salary instalments and ₹8,00,000 payable by the State within eight weeks; departmental proceedings ordered against the Tahasildar; copy of the judgment to be placed before the Chief Secretary and Revenue Secretary; Chief Secretary directed to issue detailed demolition guidelines to all Revenue officials and Municipal authorities in line with the Supreme Court's directions; interim orders vacated; contempt petition (CONTC) disposed of being dropped. The petitioners' claimed Rs. 1 crore compensation was not awarded as such.
