Heard learned counsel for the respective parties.

Instant petition under Section 483 BNSS is filed for release of the petitioner on bail in connection with C.T. Case No.547 of 2021 pending in the file of learned NGN-cumJ.M.F.C., Bhograi corresponding to Bhograi P.S. Case No.169 of 2021 on the grounds stated.

Perused the FIR as at Annexure-1 and rejection order i.e. Annexure-2.

A copy of the order in BLAPL No.7859 of 2021 in respect of the co-accused, namely, husband of the petitioner, who is on bail is produced by Mr. Jena, learned counsel

appearing for the petitioner at the time of hearing. It is submitted that the petitioner did not play any specific role during the alleged incident, which is revealed from the FIR i.e. Annexure-1. With such submission, as the husband co-accused has been granted bail by this Court, on parity, release of the petitioner is requested.

An objection is received from Mr. Ray, learned AGA for the State considering the nature of allegations revealed from the FIR.

On a reading of the report lodged by the informant, it is made to suggest that the alleged occurrence took place with the involvement of other accused persons and in that connection, the petitioner is arrested, who is in custody from 11^th August, 2025. The name of petitioner’s husband does find a mention in the FIR i.e. Annexure-1, who said to have assaulted the deceased along with others being arm with a ‘sabal’. As the husband accused is on bail by BLAPL No.7859 of 2021 and from the FIR, no specific role is attributed against the petitioner and she being a woman and in custody ever since arrested, the Court is in favour of her release with suitable conditions.

7. Accordingly, it is ordered.

In the result, the petition under Section 483 BNSS stands allowed. Consequently, the petitioner is directed to be released on bail in connection with C.T. Case No.547 of 2021 arising out of Bhograi P.S. Case No.169 of 2021 subject to her

furnishing a bail bond of Rs.40,000/-(rupees forty thousand) with one solvent surety for the like amount to the satisfaction of the learned NGN-cum-J.M.F.C., Bhograi, who shall be at liberty to impose such other suitable conditions as deemed just and proper and in the facts and circumstances of the case.

9. The BLAPL is disposed of.
