The prayer for bail of the petitioner was rejected by the learned Sessions Judge, Nayagarh vide order dated 03.09.2025.

Learned counsel for the petitioner submits that the petitioner is in judicial custody since 14.08.2025 and

the allegation against the petitioner is that he committed robbery and cash of Rs.2,800/- (rupees two thousand eight hundred) and one mobile hand set was seized from the possession of the petitioner and in view of the nature of accusation against the petitioner, the bail application of the petitioner may be favourably considered.

Learned counsel for the petitioner has produced the seizure list in support of his contention, which is taken on record.

Learned counsel for the State, on the other hand, opposed the prayer for bail only on account that the petitioner has got two criminal antecedents.

Learned counsel for the petitioner further submits that in those cases, the petitioner was in bail.

Considering the submissions made by the learned counsel for the respective parties, the nature of accusation against the petitioner, the progress of investigation and taking into account the period of detention of the petitioner in judicial custody, I am inclined to release the petitioner on bail.

Let the petitioner be released on bail in the aforesaid case on furnishing a bail bond of Rs.20,000/(rupees twenty thousand) with two solvent sureties for the like amount to the satisfaction of the learned Court in seisin over the matter with further conditions as the learned Court below may deem just and proper including the conditions that the petitioner shall not

indulge in any criminal activities, shall not tamper with the evidence, shall appear before the learned trial Court on each date to which the case would be posted for trial and shall cooperative with the investigation.

Violation of any of the conditions shall entail cancellation of bail.
