The Petitioner being in custody in Chandbali P.S. Case No.314 of 2023 corresponding to S.T. Case No.51 of 2024 pending in the court of learned Addl. Sessions Judge, Bhadrak, registered for the alleged commission of offences under Sections 302/201 of IPC, has filed this petition for his release on bail.

The brief fact of the case is that the deceased named Sukanta Das was found to be with the petitioner up to 8.30 P.M. of 13.10.2023 near the bridge of Natia joro of villageJyotisingpur. As the deceased had left home around 7 P.M. on 13.10.2023 on the pretext of attending call of nature and did not return to home in time. The informant, who happens to be the father of the deceased, telephoned him (the deceased) but did not get any reply though the phone of the deceased was ringing continuously. When the informant went to the house of the petitioner to enquire about his deceased son, the petitioner expressed his ignorance about whereabouts of the deceased. Getting mentally disturbed the informant and his family members searched for the deceased. On 15.10.2023 at about 7 A.M. it was found that the dead body of the deceased was floating on river 'Salandi'. The informant lodged F.I.R.

which was registered as Chandbali P.S. Case No.314 dated 15.10.2023. Hence, this case.

Learned counsel for the Petitioner submits that out of 20 charge sheeted witnesses, only 5 witnesses have already been examined. Most of the witnesses have not supported the case of the prosecution. He further submits that the Petitioner is in custody since 16.10.2023. Hence, he prays that the Petitioner may be enlarged on bail on any stringent terms and conditions.

Learned counsel for the State submits that the Petitioner alleged to have been involved in heinous crime of murder. Hence, he vehemently opposes the prayer for bail. She further submits that just period of long detention cannot be a ground for release the petitioner on bail in such a heinous crime.

Considering the nature and gravity of the accusation, character of evidence appearing against the Petitioner, the stringent punishment provided and that there are reasonable grounds for believing that the Petitioner is not guilty of the offence alleged or not likely to commit any such offence, which is not possible to record in this case, the prayer for bail is devoid of merit. Hence, his prayer for bail stands rejected.
