This matter is taken up through Hybrid Arrangement (Virtual/Physical Mode).

This is the 2^nd successive bail application U/S.483 of BNSS by the petitioner for grant of bail in connection with Belapada P.S. Case No.52 of 2022 corresponding to Sessions Case No.47 of 2022 (G.R. Case No.196 of 2022) pending in the file of learned Addl. Sessions Judge, Patnagarh, for commission of offences punishable U/Ss. 302/120-B of the IPC r/w. Section 25/27 of the Arms Act, on the allegation of committing murder of one Luku @ Lokanath Biswal by firing at him, along with co-accused persons.

Heard, Mr. Soumik Spandan Tripathy, learned counsel for the petitioner and Mr. P. Satpathy, learned Addl. PP in the matter and perused the record.

At the outset, it is brought to the notice of the Court that all the witnesses have already been examined and right now the case stands posted for recording of the accused statement. Further, Mr. P. Satpathy, learned Addl. PP submits that the petitioner has been identified in the TI parade. Mr. Tripathy by referring to the evidence of the witnesses has tried to make out a case to distinguish the evidence to grant bail to the petitioner. However, this Court on going through the evidence of the witnesses, more particularly the evidence of PW.2, is not inclined to grant bail to the petitioner, especially when the trial is likely to be concluded in near future.

At this stage, Mr. Soumik Spandan Tripathy, learned counsel for the petitioner prays to withdraw the bail application, but this Court is not inclined to grant that liberty and instead reject the bail application.

Hence, the prayer for bail of the petitioner stands rejected.

Accordingly, the BLAPL stands disposed of. 6. Issue urgent certified copy of the order as per Rules.
