2 . Heard learned counsel for the Petitioner and learned counsel for the State.

3 . The Petitioner is in custody in connection with C.T. Case No.734 of 2024 further corresponding to C.T. Case No.234 of 2024 arising out of Laxmisagar P.S. Case No.333 of 2024 pending in the court of learned Ad-hoc Additional District and Sessions Judge, Bhubaneswar, registered for the alleged commission of offence under Sections 376D/354/385/379/506/36 of I.P.C. has filed this petition for his release on bail.

It is alleged by the informant that on 17.06.2024 at about 11.50 pm evening the informant/victim filed a complaint before Laxmisagar PS that in order to search a house she requested his friend viz Abhinash Naik for help. Subsequently, the Abhinash Naik gave reference of “Primary/Main accused responsible for the alleged crime-Akhya Kumar Das” along with mobile number and described that Ashya is a social worker & helping students, believing the say the victim contacted “Akhya”. Subsequently, on 11.06.2024 at about 5.00 pm, the Akhya Kumar Das came with a Black Colour Car and told the victim to accompany him. On the way the main accused offered the victim a Fruity Cold Drink and after consuming that soft drink she

got unconscious. On the next date i.e. on 12.06.2024, the main accused released & dropped her at Jagannath NagarLane No-5. During the period, the victim understood that she was abducted & abused by the Akshay Ku Das and on question, he (Akhya) threatened her and her elder sister that “if the matter was disclosed at spread then he will kill them”. As such, during her abduction her mobile phone, cash of Rs.6,500/- and one gold ring were also stolen by the Principal/FIR accused Akshay Ku Das. Subsequently, the main/FIR accused Akshay Ku Das threatened her father that if the matter was escalated then her (Victim’s) naked videos and sexual scenes will be spread in social media also. It is also alleged by Laxmisagar Police that during investigation they interrogated the victim as-well-as the main/FIR accused Akshay Ku Das and the petitioner (Sk. Akram) and found guilt (as they have confessed) in the commission of the offence, Searches and seizures were made under Section 161 statements.

5 . Learned counsel for the petitioner submits that the petitioner has no involvement whatsoever in the alleged offences as claimed by the prosecution. It is further submitted that the petitioner has been in judicial custody since 17.07.2024. He further submits that he co-accused

persons have already released on bail. Accordingly, it is prayed that the Petitioners be released on bail.

6 . Learned counsel for the State vehemently opposes the prayer for bail, emphasizing the seriousness of the allegations.

7 . Considering the nature of gravity of the accusation, character of evidence appearing against the petitioner, the stringent punishment provided, this Court is not inclined to release the petitioner on bail.

8. Accordingly, the BLAPL is dismissed.

9. Issue urgent certified copy of the order pas per Rules.
