Heard Mr. Dash, learned counsel for the petitioner and Mr. Ray, learned AGA for the State.

Instant petition under Section 483 BNSS is filed for release of the petitioner on bail in connection with S.T. Case No.67 of 2025 corresponding to C.T. Case No.335 of 2025 arising out of Karanjia P.S. Case No.208 of 2025 pending in the file of learned Additional Sessions Judge, Karanjia on the grounds stated therein.

Perused the statement of the victim recorded under Section 180 BNSS. The submission is that the petitioner and the victim were in a relationship for about four years and thereafter, with the allegation of rape, the FIR was lodged. The victim’s statement recorded during investigation further reveals that she became pregnant after such relationship between them

and by the time of her examination, she was three months pregnant. It is claimed by the victim that the petitioner is responsible for her present condition and an allegation of rape is also alleged by her. Recorded the objection of the State to the release of the petitioner on the ground that the rape is alleged against him. A copy of the statement of the victim recorded under Section 180 BNSS is also produced in Court which reveals that she had been in a relationship with the petitioner. Considering the above facts and on account of dispute that has arisen when the petitioner declined to marry the victim and such relationship was developed allegedly on a promise of marriage and the petitioner being in custody from 27^th September, 2025, this Court is inclined to direct him to go on bail subject to following conditions.

Hence, it is ordered.

In the result, petition under Section 483 BNSS stands allowed. Consequently, the petitioner is directed to be released on bail in connection with S.T. Case No.67 of 2025 corresponding to C.T. Case No.335 of 2025 arising out of Karanjia P.S. Case No.208 of 2025 subject to him furnishing a bail bond of Rs.50,000/-(Rupees fifty thousand) with one solvent surety for the like amount to the satisfaction of learned Additional Sessions Judge, Karanjia, who shall be at liberty to impose such other suitable conditions as deemed just and proper in the facts and circumstances of the case besides the following, such as, he shall submit an undertaking at the P.S. not to cause any harm to the victim after being released and to

continue to attend the P.S. before the I.O. even though the investigation is concluded at least for a period of six months after such release.
