Heard Mr. Dash, learned counsel for the petitioners and Ms. Dash, learned ASC for the State.

Instant petition under Section 483 BNSS is filed for release of the petitioners on bail in connection with Mohana P.S. Case No.42 of 2025 corresponding to G.R. Case No.43(A) of 2025 pending in the file of learned J.M.F.C., Mohana on the grounds stated therein.

From the record, it reveals that the co-accused persons have been granted bail in BLAPL No.6024 of 2025 at Flag-A. It is submitted that the petitioners are alleged to be involved in the incident and committed the mischief, as a result, have been charge sheeted. The raiding party of the local police was obstructed by the accused persons and in connection therewith, the FIR was lodged, a copy of which, is at Annexure-1.

The trial has not commenced but with similar allegations the petitioners have been involved. Gone through the FIR. The petitioners are equally placed like the co-accused persons, who have been released on bail by Court’s order in BLAPL No.6024 of 2025. In fact, from Annexure-1, this Court finds that all the accused persons named therein have committed the overt acts leading to the registration of the case. Considering the above facts and objection of the State, this Court is of the view that the petitioners should be allowed to go on bail subject to following conditions.

5. Hence, it is ordered.

In the result, petition under Section 483 BNSS stands allowed. Consequently, the petitioners are directed to be released on bail in connection with Mohana P.S. Case No.42 of 2025 corresponding to G.R. Case No.43(A) of 2025 subject to them furnishing bail bonds of Rs.30,000/-(Rupees thirty thousand) each with one solvent surety each for the like amount each to the satisfaction of learned J.M.F.C., Mohana, who shall be at liberty to impose such other suitable conditions as deemed just and proper in the facts and circumstances of the case.
